Five years ago, on Dec. 6, 2018, Michigan made history by legalizing recreational cannabis through the Michigan Regulation and Taxation of Marijuana Act. This momentous decision, driven by a decisive victory at the polls the month before, marked a significant shift in the state’s approach to cannabis. With 55.9% of Michigan voters approving Prop 1, the state became the first in the Midwest to legalize cannabis for adults 21 and older.
Proposition 1 brought about several key provisions, including the legalization of adults’ possession of up to 2.5 ounces of cannabis and the secure home cultivation of up to 12 plants. Moreover, it set the stage for the regulation, taxation, and legalization of cannabis production and sales while directing efforts toward fostering equity within the industry.
The journey toward legalization was a collaborative effort, with activists, campaign staff, and volunteers working tirelessly to end the war on drugs. The Marijuana Policy Project (MPP) played a leading role, leveraging grassroots support to bring about this transformative change.
Since the first legal sales began just over a year after the vote, Michigan’s cannabis landscape has continued to evolve. While progress has been made, challenges persist. Many cities still lack cannabis businesses, although statewide delivery services are now operational.
Recent developments in Michigan highlight ongoing efforts to address issues related to cannabis use and employment. The removal of cannabis from pre-employment drug testing for most non-test designated jobs by the Michigan Civil Service Commission represents a significant step forward. This change, effective since October 1, 2023, aims to reduce barriers to employment for individuals who use cannabis recreationally.
However, disparities remain, as local government staff and private employees are still vulnerable to discrimination based on cannabis use. The impact of decades of prohibition is felt by hundreds of thousands of Michiganders with criminal records, hindering their access to employment, housing, and education.
To address this issue, Governor Gretchen Whitmer signed bills in the fall of 2020 aimed at expunging cannabis offenses from records. These efforts, including the Clean Slate laws, streamline the expungement process and provide relief for individuals burdened by past convictions. In addition to adult-use legalization, Michigan has a robust medical marijuana program, which was expanded and regulated by legislative action in 2016. The state’s cannabis laws allow for home cultivation of up to 12 plants, subject to specific regulations designed to ensure safety and security.
